Prophet Magaya’s company ordered to refund US$2 123 after ‘botched’ residential stand deal

A company owned by the Prophetic Healing and Deliverance (PHD )Ministries church has been ordered to reimburse a congregant of her hard earned US$2 123 which she contributed towards the purchase of a residential stand.
Papers gleaned by The Humanitarian Post under the Magistrates Court record number C-CD 428/22 shows that a default order was granted in favor of one Mercy Chipunga to collect her dues from the top cleric’s related company, Planet Africa Limited.
“It is hereby ordered that, Default Judgment be and is hereby entered against the defendant.
The defendant be and is hereby ordered to pay the sum of US$2 143 payable in ZWL using the equivalent interbank rate on the date of payment being refund amount paid by plaintiff in pursuance of allocation of a residential stand and for which defendant failed to so,” the order reads in part.
The judgment also orders an additional 20% penalty for non- allocation of the residential stand over and above the payment of the plaintiff’s legal costs at legal practitioner – client scale.
The plaintiff who is being represented by Alex Majachani of Alex F. & Associates submitted to the court that around 2016, the defendant through its agents marketed residential stands to the diaspora community in South Africa where she was resident.
In pursuance of this drive, Defendant, an outfit company of PHD Ministries, offered an opportunity to PHD Ministries partners in the diaspora to acquire residential stands back in Zimbabwe.
Magaya’s company allegedly marketed and represented that it had vast undeveloped land holdings across Zimbabwe for subdivision and development.
On the basis of this, Plaintiff entered into an agreement to be a partner of the PHD Ministries contributing a total amount of US$2 123 as deposit towards the allocation of residential stand.
However, despite numerous follow ups nothing has materialised prompting the pursuit for the court order.
