Lawyers demand urgent release of NetOne CEO by ZACC, says officials lack evidence

LAWYERS representing the NetOne CEO, Raphael Mushanawani have dismissed the arrest arguing that it borders on very weak evidence which demonstrates the ZACC officials’ lack of knowledge on corporate governance systems.
The NetOne CEO was arrested early this week on allegations of fraud involving US$1,2 million through the engagement of consultancy services and purchase of ICT services.
But is a recent twist, which could expose the ZACC and further confirm the sustained record of nabbing suspects without water tight evidence, lawyers representing Mushanawani have described the whole act as unnecessary and devoid of evidence.
“Our client is at a loss as to why he finds himself languishing in police custody over an issue which exposes your officers lack of understanding of IT Systems.It should have been clear to your officers that the SAP Enterprise Resource Planning System , which NetOne Cellular Pvt Ltd contracted Farevic Systems Limited to supply and implement , is totally different from the SAGE 1000 or SAGE L200.It is common cause that NetOne has been using SAGE 100 System to manage its core business.
“Contrary to your claims , the upgrading of the SAGR ERP 100 to SAGE 200 was imperative.This was key and had been approved by the board,” the lawyers said.
They further argued that both systems had to run in parallel until new one was proven fully functional.
The lawyers also rejected claims that Mushanawani signed addenda worth US$1,2 million to upgrade the SAGE system.
“This is false , and you are challenged to provide such evidence.For your information , the only payments which have been made thus far are for US$184 800 and US$88 002,57,”the letter reads.
The lawyers are also dismissing allegations that Mushanawani entered into an unapproved consultance contract with Diztech Pvt Ltd for US$ 79 467.
For then record , they said, there is no contract that was signed between Diztech Pvt Ltd and NetOne as alleged , neither has there been any payment of even a dime to Diztech Pvt Ltd ….since no such services were ever provided.
The legal team contends that the allegations are a part of deliberate campaign to oust him from his position.
The attached board documents to support their case and warned ZACC against being used in what they called an orchestrated plot.
