Byo daughter dupes own mom , evicts her from her  house

IN a shocking tale of family betrayal, an elderly woman from Entumbane suburb has been left devastated, after her own daughter orchestrated a calculated scheme to strip her of her house through manipulation and fraudulent documentation.

The heart-wrenching incident reveals a disturbing narrative of exploitation of the elderly, where trust was brutally shattered by the very person meant to protect and take care of a parent in her vulnerable years.

According to court documents, Ms Siphiwe Moyo (age not specified) was misled by her daughter Floid Ngwenya into believing that she was securing her house from being sold, only to discover that it was a trick.

It was stated in documents that Ms Moyo purchased the property in 1998 from the Bulawayo City Council.

“The stand was purchased by the plaintiff, and the memorandum of agreement between her and city council was signed on the 29th of January 1998.

“Whereby the municipality sold and the purchaser purchased stand number 30099/30 Entumbane, Bulawayo, thus acquiring personal rights to the property from the Bulawayo City Council,” read the document.

It was stated that sometime in 2015, Ngwenya hatched a plan to deceive her mother, who was then residing at her rural home in Mberengwa, into signing papers purportedly to “protect” her house from being stolen.

“Upon hearing this, the plaintiff came to Bulawayo as she feared losing her property. The plaintiff was taken to the Entumbane Housing Office, wherein she was coerced into signing papers ceding ownership to the defendant.

“The plaintiff was forced to sign a  letter cancelling the memorandum of sale between her and the municipality of Bulawayo on the 2nd April 2015,” reads court documents

“However, the Town Clerk signed the document on the 13th of May 2015, which makes the dates of the signing of the letter and the authenticity of the document questionable.”

The records further stated that Ms Moyo was not informed by her daughter or the Town Clerk of the papers she was signing, and was just told to make an impression of her thumb on the document.

“Furthermore, a letter was handwritten and was submitted by the defendant on the 12th of March 2015 and it was purported to have been written by the plaintiff.

“The Defendant is now evicting the plaintiff from house number 30099/30 as she is now claiming it as her own.”

Ms Moyo, through the courts, has since been granted an order for ‘rei vindication’. An order for rei vindication is a court order granting the legal owner the right to recover their property from anyone who possesses it without their consent.

The court also ordered that Ngwenya cede and transfer ownership of the property to Ms Moyo within seven days of receipt of the order, which was on Friday.
