THE Zimbabwe Republic Police (ZRP) says controversial businessman Delesh Nguwaya cannot be arrested because the Courts have since cleared his of all the charges leveled against him.
The ZRP was responding to numerous media and public inquiries on the arrest of the businessmen.
Nguwaya made headlines in 2020 when he was arrested and charged with fraud in connection with a Coronavirus tender scam that saw the government paying his Drax International LLC an amount of about US$1 million.
He was released on 50 thousand Zimbabwe dollars bail before being removed from remand on December 1 2020 by Harare magistrate Ngoni Nduna.
But in an update, ZRP spokesperson Assistant Commissioner Paul Nyathi clarified the position on the matter.
He said thorough investigations on the matter were conducted leading to the submission of the docket to the National Prosecuting Authority of Zimbabwe.
“The Police has also taken note of the Supreme Court of Zimbabwe and the NPA’s decision on the fact that the money that was paid by Drax Consul Sagl by Treasury has been cleared and deemed clean money which should be paid to Drax dor the medicines which were delivered and consumed by various medical facilities in the country,” said Nyati in the statement.
He said the Supreme Court then made a pronouncement under Judgment number SC 66/23 and Civil Appeal number 173/22 establishing that the contract between NatPharm and Drax Conult Sagl was valid.
On that basis, said the police, the NPA has since declined to prosecute Nguwaya because of the validity of the contract between NATPHARM and Drax Consult Sagl.
